Ms. Mottek, the heart and soul of the firm, has served as lead or co-lead counsel in countless class actions in both federal and state court, at the local and at the national level.
Ms. Mottek was admitted to the California bar in 1986 and was associated until 1994 at the firm of Brobeck, Phleger & Harrison, in San Francisco, California, during which time she defended clients in class actions and represented plaintiffs and defendants in other complex business litigation. She tried three cases, all successfully, to verdict while she was at the Brobeck firm. From 1994 until 2002, she was a partner with the firm Lieff Cabraser Heimann & Bernstein in San Francisco. She served as one of the co-lead counsel in the federal antitrust case, In re Travel Agents Commission Litigation ( N.D. Minn. ); was the lead lawyer in a federal employment race discrimination action, Carter v. UPS (N.D. Cal.); a member of the lead counsel team in gender discrimination employment litigation against Home Depot; one of co-lead counsel in breast implants litigation pending in Louisiana, and co-lead counsel in the consumer action, Spielholz v. AT & T Wireless, filed in the Superior Court for Los Angeles County. In Spielholz, she drafted a petition for a writ of mandamus to the California Court of Appeal, which remarkably granted the petition. The Court of Appeal determined that consumer claims for monetary relief are not pre-empted by the Federal Communications Act. Ms. Mottek also had a significant role as a member of the co-lead team in the CaliforniaBrand Name Prescription Drug Antitrust Litigation, in the federal Compact Disk Antitrust Litigation and in many other class action cases.
In 2002, Ms. Mottek became Of Counsel to the firm now known as Coughlin Stoia Geller Rudman & Robbins, LLP. She was co-lead counsel in the consumer cases known as Tenet Healthcare Pharmaceutical Pricing Litigation, filed in the Superior Court for the County of Los Angeles, which settled very favorably for the consumer class. In 2007, she also served as lead counsel in the action known as Browning v. Capital One Bank, filed in the Northern District of California.
Ms. Mottek currently serves as a member of the executive committee and co-lead counsel in the coordinated proceedings pending in Alameda County, In re Cellphone Termination Fee Cases, JCCP No. 4332. One of those coordinated cases settled last summer for $ 21 million.
