From 1994 until 2002, Ms. Mottek was a partner with the nationally-recognized plaintiffs' class action law firm Lieff Cabraser Heimann & Bernstein in San Francisco. She was co-lead counsel in the consumer action, Spielholz v. AT & T Wireless, filed in the Superior Court for Los Angeles County. In Spielholz , she drafted a petition for a writ of mandamus to the California Court of Appeal. The Court of Appeal granted the writ petition, determining that consumer claims for monetary relief are not pre-empted by the Federal Communications Act. In 2002, Ms. Mottek became Of Counsel to the firm now known as Coughlin Stoia Geller Rudman & Robbins, LLP. She served as co-lead counsel in the consumer cases known as Tenet Healthcare Pharmaceutical Pricing Litigation, filed in the Superior Court for the County of Los Angeles, which settled very favorably for the consumer class. In 2007, Ms. Mottek also served as sole lead counsel in the action known as Browning v. Capital One Bank, filed in the Northern District of California.
Ms. Mottek serves as co-lead counsel and Executive Committee member in the In re Cell Phone Early Termination Fee cases coordinated before the Superior Court of the County of Alameda from the inception of the matters in 2003. Two of those cases were tried simultaneously to the Court and to a jury. The first action against Sprint Nextel resulted in the court's determination that Sprint Nextel's early termination fees are illegal under California law. The second action against Verizon Wireless settled during the trial in the summer of 2008.
